Portia’s speech in The Merchant of Venice captures the tension perfectly: mercy is “twice blest — it blesseth him that gives and him that takes.” But Shylock has a point too: a contract is a contract, and selective mercy is just favoritism by another name.
Every parent faces this tension daily. Every judge. Every leader. Pure justice without mercy is mechanical and inhuman. Pure mercy without justice enables harm and abandons victims.
The great religious traditions circle this endlessly. In Judaism, God is both just (din) and merciful (rachamim), and the interplay between them is the drama of existence. In Christianity, the cross is explicitly framed as the resolution of this tension — though theologians have debated how for two millennia. In Islam, God’s mercy is said to exceed His wrath, but accountability remains.
Restorative justice attempts a practical synthesis: accountability without mere punishment, healing without mere forgetting. It does not always work. But it is an honest attempt to hold both poles.
